Eli Lilly and Co. and the State of Alaska have agreed to settle the state’s lawsuit against the drug maker over the use of Zyprexa. Lilly will pay the state $15 million and agreed to ensure that Alaska is treated as favorably as any other state that may settle with the company in the future over similar claims.
Alaska was the first state that took the company to trial over marketing of Zyprexa for use by the State’s Medicaid program. At least nine other states have sued Eli Lilly for illegally marketing the drug for unapproved uses and concealing the drug’s side effects.
Alaska Attorney General Talis J. Colberg and Lilly announced the settlement early today. The trial began March 3, 2008, in Superior Court in Anchorage…
